Website Terms and Conditions
Effective date: October 12, 2026
These Website Terms and Conditions (“Terms”) govern use of https://www.trustplanettreepa.com/ (“Website”), operated by Trust Planet Tree Service (“Trust Planet,” “we,” “us,” or “our”).
We provide tree services in the Greater Philadelphia region and operate from Horsham, Pennsylvania. We do not maintain a public storefront.
Please read these Terms before using the Website or submitting information.
1. Scope of These Terms
These Terms address use of the Website and inquiries submitted through it.
They do not replace a written estimate, work authorization, or service agreement for tree services. Project-specific matters—including pricing, payment, cancellation, scheduling, access, permits, cleanup, and responsibility for work—must be addressed in the applicable service agreement.
If these Terms conflict with a signed service agreement concerning on-site work, the service agreement controls that work, subject to applicable law.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
2. Eligibility and Authority
You may browse the Website for lawful purposes.
If you request an estimate or authorize services, you must be at least 18 years old and have the legal authority to act for yourself or the property owner or organization you represent.
You agree to provide accurate contact and project information and to correct material inaccuracies that could affect our evaluation of your request.
Submitting a request does not establish that you own a property or have authority to authorize work on it. We may request confirmation before proceeding.
3. Website Information
The Website provides general information about our services, completed projects, and related topics.
We make reasonable efforts to keep information accurate, but Website content may be incomplete, outdated, or subject to correction. Service descriptions do not guarantee that a particular service is appropriate or available for every property.
Photographs, case studies, reviews, and descriptions illustrate particular projects or experiences. They do not guarantee the same result, timing, or cost for another property.
Website information does not replace an on-site assessment or professional advice specific to your circumstances.
4. Estimates and Service Requests
Submitting a contact form, sending photographs, making a telephone inquiry, or requesting an estimate does not:
- Create a binding agreement for tree services.
- Confirm an appointment or completion date.
- Authorize us to enter your property or begin work.
- Guarantee a particular price or scope.
- Guarantee that we can accept the project.
A project proceeds only after the parties agree to the applicable scope and authorization requirements.
Preliminary information provided remotely may need to be revised after inspection. Relevant factors can include tree condition, access, nearby structures, utility lines, equipment needs, disposal requirements, permits, and other site conditions.
Any changes to an accepted scope or price must be handled under the applicable service agreement and law. These Terms do not authorize unilateral charges for additional work.
5. Service Area and Availability
We serve approved locations within the Greater Philadelphia region. Availability depends on your location, project requirements, staffing, equipment, weather, and other operating conditions.
A reference to a city, county, or region does not guarantee availability at every address within that area.
Any emergency-service language on the Website remains subject to our actual availability and an express response confirmation. It does not guarantee immediate dispatch or a particular arrival time.
6. Emergencies and Hazardous Conditions
Website forms and email are not emergency dispatch systems and may not be monitored continuously.
If a tree or branch creates an immediate threat to life, involves a downed or potentially energized utility line, or creates another emergency, keep a safe distance and contact 911 or the relevant utility as appropriate.
Do not attempt hazardous tree work based on Website information. Do not approach a dangerous tree, climb it, or enter an unsafe area to obtain photographs for an estimate.
7. Project Agreements and Consumer Rights
Deposits, payment schedules, cancellation rights, refunds, warranties, and other terms for physical services will be addressed in the applicable service agreement.
These Website Terms do not impose a cancellation fee, make a deposit nonrefundable, waive a statutory cancellation period, or establish a warranty for tree work.
Where applicable law requires a written contract, specific disclosures, cancellation notices, or other consumer protections, those requirements remain in effect.
Requesting urgent service through the Website does not waive statutory rights or substitute for any legally required emergency authorization.
8. Photographs, Documents, and Other Submissions
When submitting photographs, documents, or other materials, you represent that you are entitled to provide them for the requested purpose.
Do not submit materials that:
- Unlawfully disclose another person’s private information.
- Infringe intellectual property rights.
- Contain malicious code.
- Are fraudulent, threatening, or otherwise unlawful.
You retain your ownership rights in submitted materials.
You grant us a limited, nonexclusive permission to use, store, reproduce, and share those materials as reasonably necessary to evaluate your inquiry, prepare an estimate, perform authorized services, and maintain relevant records, subject to our Privacy Policy and applicable law.
This permission does not authorize us to publish identifiable photographs of you or your property for advertising without an appropriate separate permission or other lawful basis.
9. Permitted Website Use
You agree not to:
- Use the Website for fraud, impersonation, or unlawful activity.
- Submit knowingly false inquiries.
- Introduce malware or attempt unauthorized access.
- Interfere with Website security or operation.
- Collect personal information from the Website unlawfully.
- Copy or commercially exploit Website content without permission, except as permitted by law.
- Use automated tools in a way that materially disrupts the Website or bypasses access restrictions.
This section does not restrict lawful consumer reviews, legally protected expression, or activities that applicable law permits.
10. Intellectual Property
Unless otherwise identified, Website text, photographs, graphics, logos, and other content belong to Trust Planet or are used with permission.
You may view the Website and print or save reasonable portions for personal, noncommercial purposes, including evaluating our services.
Other uses require permission from the appropriate rights holder unless an applicable legal exception allows them. Do not remove copyright or ownership notices.
Third-party names and trademarks remain the property of their respective owners.
11. Third-Party Links and Services
The Website may link to third-party websites or display third-party tools and content, such as maps, reviews, or videos.
Those third parties operate under their own terms and privacy policies. We do not control their websites or guarantee their content, availability, or practices.
A link does not itself establish an endorsement, partnership, or guarantee.
12. Privacy and Communications
Our Privacy Policy explains how we handle personal information submitted through or collected in connection with the Website.
When you request information or services, we may respond using the contact details you provide. This does not, by itself, enroll you in optional promotional communications.
Any legally required consent for marketing, optional cookies, or other processing will be requested separately. Agreement to these Terms is not a substitute for that consent.
13. Website Availability and Disclaimers
To the extent permitted by law, the Website is provided on an “as available” basis. We do not promise uninterrupted access, error-free operation, or compatibility with every device.
We may update, suspend, or discontinue Website features for maintenance, security, or operational reasons.
Any disclaimer in these Terms applies only to the Website and its general informational content. It does not replace warranties or obligations in a service agreement, excuse deficient on-site work, or exclude protections that applicable law requires.
14. Limitation of Liability
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising solely from Website outages, technical errors, or reliance on general Website information.
This limitation does not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, gross negligence, or other protected claims where applicable.
These Website Terms do not release Trust Planet from responsibility for property damage, personal injury, or other liability arising from on-site services. Those matters are governed by the applicable service agreement and law.
Nothing in these Terms limits statutory privacy or consumer remedies.
15. Restricting Misuse
We may take reasonable steps to restrict access associated with suspected unlawful activity, security threats, or material misuse of the Website.
Restricting Website access does not cancel an existing service agreement or eliminate either party’s obligations under that agreement.
16. Governing Law and Disputes
These Terms are governed by Pennsylvania law, except where applicable law requires otherwise.
If a dispute arises, you may contact us at contact.trustplanet@gmail.com so that we can attempt to resolve it.
Contacting us first is not a prerequisite to exercising a statutory right, filing a complaint with an authority, seeking urgent relief, or bringing a claim.
Any court proceeding must be brought in a court with appropriate jurisdiction and venue under applicable law. Nothing in these Terms requires arbitration, waives a jury trial or class-action right, or removes mandatory protections available to you.
17. Changes to These Terms
We may revise these Terms as Website features or legal requirements change. Revised Terms will be posted with an updated effective date.
Changes apply prospectively and do not retroactively alter an accepted service agreement. Where a change requires notice or agreement under applicable law, we will provide that notice or obtain that agreement.
18. Severability and Waiver
If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
